ergonomicoffice Trading Terms and Conditions

Definitions
The “SUPPLIER” means ergonomicoffice Pty Limited
The “BUYER” means the person or entity providing a communication to procure the supply of goods.
The “GOODS” mean the products subject to an accepted order.
An “ORDER” means a note, letter, order form or official purchase order from the Buyer to the Supplier by way of email, mail or fax.

Warranties
ergonomicoffice provides for a 3 year warranty on Furniture items and 1 year on accessories under normal use & conditions. The Trade Practices Act 1974 and the Fair Trading Act 1987 imply a standard manufacturer warranty and conditions to a buyers purchases.

Returns
Provided 14 days have not elapsed from the date of the delivery then the buyer may write to the supplier to show cause as to why they wish to return the goods. Should you purchase recommended ergonomic equipment that is deemed unsuitable, then we are happy to refund or exchange the equipment if the goods are returned in new condition with complete packaging intact - less a 20% administration fee. The administration fee is charged for duplicate processing and depreciation of individual products. All returned goods must be in new condition and have their complete packaging intact.

Payment
Cheque or Electronic Funds Transfer
STRICTLY WITHIN 30 DAYS FROM DATE OF INVOICE
Should payment not be made to the Supplier in full consistent with the time allowed for on the invoice then the buyer’s account automatically becomes a STOP CREDIT account with no further supply until the arrears are brought up to date .

Debt Recovery Costs
All debt recovery costs incurred by the supplier in pursuing a delinquent debtor shall be payable by the Purchaser upon demand and include but not be limited to: debt collection agency fees; legal costs arising from a Buyers payment default. Overdue account charges of 1.5 per cent interest per month.

Ownership
When the supplier fulfills an Order to the Buyer then it accepts that the Supplier retains equitable and legal title to the goods at the buyers warehouse and premises until payment is received in FULL and as a special condition grants permission to recover the goods should the account become delinquent after 60 days of the due date for payment.

Indemnity
The buyer shall indemnify the supplier against all claims, liabilities, costs and expenses associated with supply of the goods.

Law
The supplier and the buyer agree that this agreement and its
provisions shall be construed in accordance with the law of the State of the Australian Capital Territory and be resolved by an Australian Capital Territory court.

Severability
In the event that any part of these terms, conditions or provisions shall be deemed invalid, unlawful or unenforceable to any extent, such terms, conditions or provisions shall be severed from the remaining terms and conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Trade Marks, Copyright, Intellectual Property and Patents
The buyer acknowledges and agrees to protect any and all copyright, trademarks, trade names, Patents and other intellectual property rights embodied in or in connection with the fulfillment of an Order and associated information, documentation, parts or software relating to the supplied goods.
